He makes some useful contributions on the Internet and sometimes he checks out haraam things, should he stay there or leave?

 

I am a small-scale seeker of knowledge and I have some good da’wah activities on the Internet, and I am a supervisor in one of the Islamic medical chat rooms. But sometimes I slip and look on the Internet for things that are haraam whilst I am doing my research, and every time I repent to Allah, I go back to this sin. 


My question is: is it better to give up the Internet altogether, which will include giving up the good things that I do on the Internet, or is it better to treat myself and my heart and try to give up the sin altogether? I am confused between the two choices.

The solution may not be to advise you to give up the
Internet, because there are also satellite channels and magazines. Yes, you
may find in the Internet things that you will not find in the other sources
mentioned, but what we are talking about here is the basis for your
committing sin and blocking one means will not prevent a person from
committing sin. 

The solution in a case like this is to increase your fear of
Allah and your respect of Allah so that this will prevent you from falling
into that which Allah has forbidden. 

You have to remember death a great deal, so that this will
motivate you to prepare for it. 

What you have to do is to treat yourself so that you will
stop committing the sin of looking at haraam things wherever the image may
be. 

One of the most beneficial of remedies is hastening to get
married if you can do so. The Prophet (blessings and peace of Allah be upon
him) said: “O young men, whoever among you can afford it, let him get
married, for it is more effective in lowering the gaze and guarding one’s
chastity.” Narrated by al-Bukhaari (5065) and Muslim (1400). 

With regard to whether you should stay on the Internet or
not, that is subject to further discussion: 

(a)  
If you think it most likely
that you will give up the sin of haraam looking altogether by getting off
the Internet, then cut off all connection to it, so as to protect yourself
and remedy your problem, until you become certain that if you go back to it,
you will only take part in what is good in it. 

Concern about reforming yourself should take precedence over
your concern about reforming others. 

(b) 
If you think it most likely
that you will never give up the sin of haraam looking and that you will be
distracted by watching garbage on satellite channels, and looking at
newspapers and magazines, then our advice to you is to stay on the Internet,
on condition that you strive hard to keep away from every haraam thing that
can be watched or listened to. We believe that if you limit yourself to
visiting helpful and beneficial academic and news websites, and limit
yourself to regular appointments in voice chat rooms on Paltalk, where you
can offer useful and beneficial material and listen to material that will
increase your knowledge and faith, then we believe that you will never find
time to go to harmful, bad and haraam sites. 

Hasten immediately to repent sincerely from every sin that
you have committed, regret your transgressions against Allah, and resolve
firmly not to go back to those sins. Turn to Allah with a pure and sound
heart, and ask Him for help and guidance, and to purify you of haraam
things. And give thanks for the blessings that Allah has bestowed upon you
by using them to do things that your Lord loves and will make Him pleased
with you.

Persisting in a minor sin makes it a major sin

 

In Islam,there is to type of sin,that is big sin and small sin...My question is ,what type of sin is categorised with masturbation and watching pornographic and what is the punishment for the sin in hell.

Every Muslim is obliged to keep away from these images and movies which provoke desire and push one to do sinful actions such as masturbation or zina, so that this avoidance will be means of protecting oneself against haraam things. There is no doubt that watching them and persisting in doing so is a major sin, because there is no minor sin if one persists in doing it. The one who persists in doing it is regarded as having fallen into major sin because of his persistence, unlike the one who sees it just once, such as an accidental glance and the like; in that case it is regarded as a minor sin. The same applies to masturbation; if it happens just once in order to reduce the pressure of desire, Allah may pardon that because it is a minor sin, but persisting in it is a major sin.

Should he encourage a relationship between a Muslim man and a kaafir woman so as to protect her from evil and call her to good?!

 

I am in a situation where I want to invite this woman to Islam but don't know how, like we discussed about Islam and everything, she is non muslim who is going out with a muslim man, although their relationship is forbidden I am encouraging them two to stay together for 2 reasons one of them is that I do not want her to fall in love with a bisexual guy who has shown interest in her. The gay guy has a child from another lady and has slept with many men as well as women. I dont want him having children with this woman. Secondly cos her boyfriend is muslim, Im hoping he could help her become muslim inshallah. But problem is that she is getting closer to the bisexual man like they are going out to dinners and partys together which gives me the idea that something is going on. Please brother, what should I do to stop her from getting close to the bisexual guy and what should I do to help her become a muslim? Also we dont discuss religion anymore.

Firstly: 

Although we appreciate your keenness for that which is good
and your intention to do what is best for this woman, we think that you are
not doing the right thing by encouraging friendship between her and that
Muslim man. How many of those who seek to do good fail to achieve it. The
rulings of Islam should be our starting point in our actions and we should
not be ruled by our emotions which go against the laws of Allaah. 

You know that any haraam relationship between a man and a
woman leads to many things that are contrary to Islam and may lead to
falling into major sin, so how can such a relationship be a means of
achieving good for the people involved? 

Relationships between women and men outside the framework of
shar’i marriage are haraam. 

Moreover, your fear for this woman is making you expose your
Muslim brother to temptation, so this woman will be a cause of your
brother's temptation and may lead him to sins that doom a person to Hell and
to immoral actions. 

Now you are committing a haraam action in the hope of
achieving some purpose which may or may not be achieved. Such things are not
permissible according to sharee’ah. 

Secondly: 

You can achieve your goal in protecting this woman against
evil and calling her to Islam through a woman -- like her -- who is Muslim
and is close to her; thus you can call her to goodness and warn her against
evil.

To sum up: 

It is not permissible for you to encourage this haraam
relationship; rather what you must do is advise them that this relationship
is haraam according to Islam and that no one knows the unseen except Allaah.
This may be a cause of her becoming Muslim because of what she sees of
Islam’s respect for women and how it protects them.

If he puts his status on Messenger/Facebook saying that he is out when he is at home

 

What is your opinion of those who keep updating their status on websites like Facebook? For example they would update their status daily or even a few times a day and tell everyone what they are doing such as: I am at work, Going to school, doing this or that? What is your opinion of this.

What the
Muslim is required to do is to be honest in all his statements, whether he
is talking about himself or someone else, verbally or in writing, because
Allah says (interpretation of the meaning):

“O you who
believe! Fear Allaah, and be with those who are true (in words and deeds)”

[al-Tawbah
9:119] 

al-Bukhaari
(6094) and Muslim (2607) narrated that ‘Abd-Allaah ibn Mas’ood (may Allah be
pleased with him) said: The Messenger of Allah (blessings and peace of Allah
be upon him) said: “I enjoin you to be truthful, for truthfulness leads to
righteousness and righteousness leads to Paradise.
A man may continue to tell the truth and endeavour to be truthful until he
is recorded with Allaah as a speaker of truth. And beware of lying, for
lying leads to wickedness and wickedness leads to Hell. A man may continue
to tell lies and endeavour to tell lies, until he is recorded with Allaah as
a liar.” 

Whatever a
person writes about himself or his situation on Messenger or any other
website or means of communication, he must be truthful in it. It is not
permissible for him to write about himself that he is outside or in school,
for example, when in fact he is at home, because this is lying. If he
forgets to change his status (by typing or writing), he should change it
whenever he can.

Sculpting with clay – what is and is not permissible

 

I am an artist. Recently I became inclined to sculpturing from mud. I heard that it is haram. But I make it as a flattened drawing, just like a drawn picture. I would like also to know if engraving masjids and houses is as haram as engraving humans and birds?.

Praise be to Allaah.

Sculpting with clay is one
of the kinds of image-making, some of which is permissible and some is
haraam. That which is haraam is that which shows images of animate beings,
both humans and animals, because of the words of the Prophet (peace and
blessings of Allaah be upon him) which were narrated by Ibn ‘Abbaas, who
said: I heard Muhammad (peace and blessings of Allaah be upon him) say:
“Whoever makes an image in this world will be commanded to breathe the soul
into it on the Day of Resurrection, and he will not be able to do that.”
Narrated by al-Bukhaari (2112) and Muslim (2110). 

As for that which is
permissible, it is images of anything that does not have a soul, so it is
permissible to sculpt images in clay of mosques, houses, trees and other
inanimate objects. 

The scholars of the
Standing Committee said:  

The focus of the
prohibition on image making is images of animate beings, whether they are
sculpted or drawn on walls or fabric or paper, or they are woven, and
whether they are drawn with a quill or pen or made with a machine, and
whether the image is of the creature as it naturally appears or whether
imagination comes into play and it is made smaller or larger, or made
beautiful or distorted, or the skeleton inside is shown in the picture.   

The reason for the
prohibition is that what is represented is animate beings, even if they are
imaginary images such as those that are drawn to represent ancient peoples
such as the pharaohs and commanders and soldiers during the Crusades, or
images of Jesus and Mary that are placed in churches, etc. This is because
of the general meaning of the texts and because of the imitation of the
creation of Allaah, and because it is a means that leads to shirk.

Baaz, Shaykh ‘Abd al-Razzaaq ‘Afeefi, Shaykh ‘Abd-Allaah ibn Ghadyaan,
Shaykh ‘Abd-Allaah ibn Qa’ood.

al-Daa’imah (1/696) 

It is also not permissible
to do sculptures with clay for places of bid’ah which people venerate
inappropriately, such as places of worship and graves, and places of sin
such as banks and theatres. 

The scholars of the
Standing Committee said: It is not permissible to make artistic
three-dimensional images of the two Sanctuaries (Makkah and Madeenah)
because they may include images of the people in the Haram in Makkah who are
doing tawaaf and praying, and of the Qur’aan-reciters and others in
al-Masjid al-Nabawi and so on, and because there is a green dome which would
be represented in such images of al-Masjid al-Nabawi, and that may lead some
people to believe in domes and venerate them and the people buried beneath
them, which may lead to major shirk and other evils from which we seek
refuge with Allaah.

Shaykh ‘Abd-Allaah ibn Qa’ood.

In the Book of Allaah there
is an indication that sculpting figures of animate beings with clay is
haraam. Allaah says (interpretation of the meaning): 

“(Remember) when Allaah
will say (on the Day of Resurrection). “O ‘Eesa
(Jesus), son of Maryam (Mary)! Remember My Favour to you and to your mother
when I supported you with Rooh‑ul‑Qudus [Jibreel (Gabriel)] so that you
spoke to the people in the cradle and in maturity; and when I taught you
writing, Al‑Hikmah (the power of understanding), the Tawraat (Torah) and the
Injeel (Gospel); and when you made out of the clay, a figure like that of a
bird, by My Permission, and you breathed into it, and it became a bird by My
Permission, and you healed those born blind, and the lepers by My
Permission, and when you brought forth the dead by My Permission”

[al-Maa’idah 5:110] 

The one who studies this
verse will realize that the words “and when you made out of the clay, a
figure like that of a bird, by My Permission” clearly indicate that it
is haraam to make figures of clay in the form of birds – and other animate
beings – and that what ‘Eesa (peace be upon him) did was only done with the
permission of Allaah, so both actions were done by the permission of Allaah:
making the figure and breathing into it. The words “by My Permission”
indicate that it was forbidden to do that even in the law of ‘Eesa (peace be
upon him). 

Shaykh al-Islam Ibn
Taymiyah (may Allaah have mercy on him) said, explaining that the Messiah is
a slave of Allaah and a created being, not a creator: 

1 – He made out of clay a
figure like that of a bird. What is meant is that he gave it the shape of a
bird, and this kind of creation is something that all people are able to do.
One of them could make a figure of clay like that of a bird or any other
animal, but this image-making is haraam, unlike that which was done by the
Messiah, because Allaah gave him permission to do it. What is miraculous is
that he blew into it and it became a bird by Allaah’s leave. The miracle is
not just that he shaped it out of clay, because that is something that
anyone could do. The Prophet (peace and blessings of Allaah be upon
him) cursed the image-makers and said: “The most severely punished of the
people on the Day of Resurrection will be the image-makers.” 

3 – Allaah told the Messiah
that he was only making the image and breathing into it with His permission,
and the Messiah told others that he did that with Allaah’s permission.
Allaah tells us that this was one of the blessings that He bestowed upon the
Messiah (peace be upon him) as He says (interpretation of the meaning):
“He [‘Eesa (Jesus)] was not more than a slave. We granted Our Favour to him,
and We made him an example for the Children of Israel” [al-Zukhruf 43:59]. 

Al-Jawaab al-Saheeh
(4/46, 47)

Ruling on selling archaeological statues

 

What is the Islamic ruling on selling the protruding monuments, i.e. full statues, heads of statues and bodies without heads? I can trade in all types of monuments with archeologists and specialists in antiquities, monuments, and international museums and so on. The purpose is historical research.  


My social and financial circumstances are difficult. I wanted to make sure of the Islamic ruling on this type of trade before I start it, I know that the ruling is always is the same regardless the financial status.

Praise be to Allaah.

It is not permissible to make statues and three-dimensional
images of animate beings, whether they are humans, birds or animals, because
of the stern warning that has been narrated concerning that. This has been
explained in detail in the answer to question no.
7222. If it is haraam to
make something, it is not permissible to sell it, because when Allaah
forbids a thing He also forbids its price. 

Ahmad (2678) narrated that Ibn ‘Abbaas said: The Messenger of
Allaah (peace and blessings of Allaah be upon him) said: “May Allaah
curse the Jews. Fat was forbidden to them but they sold it and consumed its
price. When Allaah, may He be glorified and exalted, forbids eating a thing,
He also forbids its price.” This hadeeth was classed as saheeh by Shu’ayb
al-Arna’oot in Tahqeeq al-Musnad; it is also to be found in
al-Saheehayn. 

Shaykh Ibn Baaz (may Allaah have mercy on him) was asked: Is
it permissible for the Muslim to sell statues and store them as trade goods,
and to live on that?  

He replied: It is not permissible for the Muslim to sell or
deal in them, because it is proven in the saheeh ahaadeeth that it is haraam
to make images of animate beings, and to set up statues in general, and to
keep them. Undoubtedly dealing in them is propagating them and helping in
making them and setting them up in homes, clubs and the like. 

If that is haraam, then earning money by making them and
selling them is also haraam. It is not permissible for the Muslim to make a
living from that or to eat or clothe himself from that. If he has done that
then he must rid himself of it and repent to Allaah, may He be exalted, so
that Allaah might accept his repentance. Allaah, may He be exalted, says
(interpretation of the meaning): “And verily, I am indeed forgiving to
him who repents, believes (in My Oneness, and associates none in worship
with Me) and does righteous good deeds, and then remains constant in doing
them (till his death)” [Ta-Ha 20:82]. We have issued a fatwa stating
that it is haraam to make images of animate beings in all cases, whether
they are three-dimensional or not, by engraving, copying, dyeing or using
modern equipment such as Kodak cameras. End quote from al-Jawaab
al-Mufeed fi Hukm al-Tasweer by Shaykh Ibn Baaz (p. 49-50). 

As for that which has had the head removed, it is not
regarded as a haraam image, and there is noting wrong with keeping it and
selling it if it can be made use of, so long as it will not help in doing
anything haraam, such as if it is part of an image that is worshipped or
from which blessing is sought and so on. The fact that images from which the
head has been cut off are permissible is indicated by the report narrated by
al-Tirmidhi (2806) from Abu Hurayrah (may Allaah be pleased with him) who
said: The Messenger of Allaah (peace and blessings of Allaah be upon
him) said: “Jibreel came to me and said: I was going to come to you last
night, and nothing prevented me from entering the house where you were
except the fact that at the door of the house there was a statue of a man.
In the house there was a curtain on which there were images, and there was a
dog in the house. So order that the head of the statue that is at the door
be cut off, so that it will become like a tree, and order that the curtain
be cut up and made into two pillows that will be thrown on the floor and
stepped over, and order that the dog be taken out.” The Messenger of Allaah
(peace and blessings of Allaah be upon him) did that. That dog was a puppy
belonging to al-Hasan or al-Husayn, that was beneath a bed, and he ordered
that it be taken out. 

This hadeeth was classed as saheeh by al-Albaani in Saheeh
al-Tirmidhi. 

It was also narrated by al-Nasaa’i (5365) that Abu Hurayrah
(may Allaah be pleased with him) said: Jibreel (peace be upon him) asked
permission to enter upon the Prophet (peace and blessings of Allaah be
upon him) and he said, “Come in.” He said: How can I come in when in your
house there is a curtain on which there are images? Either cut off their
heads or make it a rug that is stepped on, for we angels do not enter a
house in which there are images. Classed as saheeh by al-Albaani in
Saheeh al-Nasaa’i. 

Al-Ismaa’eeli narrated in his Mu’jam from Ibn ‘Abbaas
(may Allaah be pleased with him) that the Prophet (peace and blessings
of Allaah be upon him) said: “The image is the head; if the head is cut off
then there is no image.” Classed as saheeh by al-Albaani in Saheeh
al-Jaami’ no. 3864. 

Based on the above, it is not permissible for you to deal in
archaeological statues that depict images of animate beings, unless the
heads are cut off. You have done well to ask about the ruling on this work
before doing it. 

You should remember that the storehouses of Allaah are full,
and His provision is ample, and there is no limit to His giving. He has
promised those who obey Him that He will grant a goodly provision. He says
(interpretation of the meaning): 

“And whosoever fears Allaah and keeps his duty to Him, He
will make a way for him to get out (from every difficulty).

3. And He will provide him from (sources) he never could
imagine. And whosoever puts his trust in Allaah, then He will suffice him.
Verily, Allaah will accomplish his purpose. Indeed Allaah has set a measure
for all things”

[al-Talaaq 65:2-3] 

“Whoever works righteousness — whether male or female —
while he (or she) is a true believer (of Islamic Monotheism) verily, to him
We will give a good life (in this world with respect, contentment and lawful
provision), and We shall pay them certainly a reward in proportion to the
best of what they used to do (i.e. Paradise in the Hereafter)”

[al-Nahl 16:97] 

All you have to do is pursue the means, and seek the help of
Allaah, and look for permissible work, then be assured of goodness and ample
provision.

Selling underwear when most of the packaging has pictures of semi-naked women on it

 

I have a shop for women’s clothing. On the packages of the under cloth there are semi naked pictures of women. If I remove these covers, the buyers may think that it is old goods. What should I do?

 
If I make the faces black this will not benefit, as the rest of the body is uncovered! My shop is for Islamic wear. There is a section for under wears which is good for is a religious sister comes she will find all she needs. I mean women who wear niqab in particular, so that they do not have to go to a mixed place to buy such things. There is a good religious sister working for me, she is in charge of this section, I do not sell anything there as I am, Alhamdulillah, religious man.

The pictures that are found
on the packaging, cartons and boxes for these clothes are things that are
not sought in and of themselves, rather they are connected to the
permissible goods, so there is nothing wrong with leaving them alone, but if
it is possible to remove them or erase them without any damage, that is
preferable. 

Shaykh Ibn ‘Uthaymeen (may
Allaah have mercy on him) was asked: What is the ruling on pictures that are
found on packaging and in magazines and newspapers?  

He replied: 

With regard to pictures
that are found on packaging and in magazines and newspapers, whatever it is
possible to avoid should be left alone; whatever cannot be avoided, if the
picture is not what is sought, then it seems that the prohibition is lifted,
based on the shar’i principle, “and [Allaah] has not laid upon you in
religion any hardship” [al-Hajj 22:78]. And hardship dictates leniency.
But keeping away from it is better. End quote from Majmoo’ Fataawa
al-Shaykh Ibn ‘Uthaymeen (2/260). 

And he (may Allaah have
mercy on him) said: The fourth category: Keeping pictures that one has no
desire for, but they come along with something else, like those which are
found in magazines and newspapers that the person does not buy for the sake
of the pictures, rather he wants what is in those magazines and newspapers,
such as news, scientific research and so on. It seems that there is nothing
wrong with this, because the images in them are not what is sought. But if
it is possible to erase them without any hardship or difficulty, that is
better. End quote from Sharh Kitaab al-Tawheed, Baab Ma Ja’a
fi’l-Musawwireen. 

What we advise you to do is
several things:

He committed adultery and his conscience is troubling him, and he wants to get rid of the foetus

 

I a Moslem single person, who lives in the USA. I committed adultery many times with the same woman. Now, the women is pregnant. I would like to know if I can marry her in order to solve the problem (I mean cover the scandal)so the baby will find a father and gets the name. Actually, unfortunately, I would prefer abortion and I wish to convince her to do that, but don't know if this is considered killing a person. If so, I would feel guilty because of that. I believe the embryo is about 6-8 weeks. Please I need your help as soon as possible, Jazak Allah Khair.

Allaah.

Firstly, my brother in Islam, I offer
you my condolences for the faith that you lost during the times when
you were committing adultery. For the Prophet
(peace and blessings of Allaah be upon him) said: “When an adulterer
commits illegal sexual intercourse, then he is not a believer at the
time he is doing it, and when a drinker of an alcoholic liquor drinks
it, then he is not a believer at the time of drinking it, and when a
thief steals, then he is not a believer at the time of stealing, and
when a robber robs, and the people look at him, then he is not a believer
at the time of doing robbery.” (Narrated by al-Bukhaari,
no. 2475) 

Have you not read what your Lord says in His
Book? 

“And come not near to unlawful sex.
Verily, it is a Faahishah (i.e. anything that transgresses its limits:
a great sin, and an evil way that leads one to Hell unless Allaah forgives
him)”

[al-Israa’ 17:32 – interpretation of the meaning] 

Do you not know that Allaah sees you wherever
you are, and He hears you when you speak? 

Do you not remember the great blessings that
Allaah has bestowed upon you? For He is the One Who heals you when you
are sick, the One Who feeds you when you are hungry and gives you to
drink when you are thirsty. And He has given you the greatest blessing
that He has bestowed upon mankind, the blessing of Islam. “Is there
any reward for good – other than good?” [al-Rahmaan 55:60 – interpretation
of the meaning] 

My brother, ask yourself, Whose dominion do you live
under? Whose provision do you eat from? By Whose command do you live?
Is it not the dominion of Allaah, the provision of Allaah, the command
of Allaah? So how can you disobey Allaah? 

Perhaps you have forgotten the hadeeth
of the Mi’raaj, in which the Prophet
(peace and blessings of Allaah be upon him) said:

“… then we proceeded and came to something like a tannoor
(a kind of oven).” [The narrator] said: “I think he said, ‘in which
there were clamouring voices.’” He [the Prophet
(peace and blessings of Allaah be upon him)] said: “We looked into it
and there we saw naked men and women. Flames were coming to them from
the bottom of it, and when the flames reached them, they made an uproar.
I said to them [i.e., the two angels who were accompanying him], ‘Who
are these?’ They said, ‘Proceed, proceed!’… I said to them, ‘I have
seen strange things this night. What is this that I have seen?’ They
said, ‘We will tell you…. The naked men and women in the structure that
resembled a tannoor oven are the adulterers and adulteresses.’”

(Narrated by al-Bukhaari in Baab Ithm al-Zunaat,
no. 7047). 

So you must hasten to repent sincerely before
death overtakes you, for the gate of repentance is open until the sun
rises from the west or before the soul reaches the throat [at death].
Allaah rejoices over the repentance of His slave, and He will change
his bad deeds (sayi’aat) into good deeds (hasanaat). Allaah
says (interpretation of the meaning): 

“And those who invoke not any other
ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden,
except for just cause, nor commit illegal sexual intercourse
and whoever does this shall receive the punishment.

The torment will be doubled to him on the Day of Resurrection,
and he will abide therein in disgrace;

Except those who repent and believe (in Islamic Monotheism),
and do righteous deeds; for those, Allaah will change their sins into
good deeds, and Allaah is Oft‑Forgiving, Most Merciful.

And whosoever repents and does righteous good deeds;
then verily, he repents towards Allaah with true repentance[al-Furqaan
25:68-71] 

Secondly, with regard to your question, “Do
I have to marry her?”, this is the issue of the adulterer marrying the
woman with whom he committed adultery. The answer is that it is not
permissible for him (the adulterer) to marry her, or for her to marry
him, until the label of adultery no longer applies to them. That label
can only be removed through repentance. 

It is not permissible for you to marry her
even if she is Jewish or Christian, because she is a zaaniyah
(adulteress). Even if she is Muslim, it is not permissible for you to
marry her because she is a zaaniyah.  And it is not permissible
for her to accept you as a husband because you are a zaani (adulterer).
Allaah says (interpretation of the meaning): 

“The adulterer — fornicator marries not but an adulteress
— fornicatress or a Mushrikah; and the adulteress –fornicatress, none
marries her except an adulterer — fornicator or a Mushrik [and that
means that the man who agrees to marry (have a sexual relation with)
a Mushrikah (female polytheist, pagan or idolatress) or a prostitute,
then surely, he is either an adulterer — fornicator, or a Mushrik (polytheist,
pagan or idolater). And the woman who agrees to marry (have a sexual
relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer
— fornicator, then she is either a prostitute or a Mushrikah (female
polytheist, pagan, or idolatress)]. Such a thing is forbidden to the
believers (of Islamic Monotheism)”[al-Noor 24:3] 

The phrase “Such a thing is forbidden to
the believers” indicates that this marriage is forbidden. 

“It is essential that both of you repent to
Allaah, give up this sin, regret the evil actions that have occurred
in the past, resolve not to return to them, and do many righteous deeds,
so that Allaah may accept your repentance and turn your bad deeds (sayi’aat)
into good deeds (hasanaat). Allaah says (interpretation of the
meaning): 

‘And those who invoke not any other
ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden,
except for just cause, nor commit illegal sexual intercourse
and whoever does this shall receive the punishment.

If you want to marry her, you have to be sure that
she is not pregnant by waiting to see if she menstruates before you
do so. If it becomes apparent that she is pregnant, it is not permissible
for you to marry her until after she delivers the baby, in accordance
with the hadeeth of the Prophet
(peace and blessings of Allaah be upon him), in which he forbade a man
to use his water to irrigate the crops of another.” 

(Fatwas of the Standing Committee in al-Buhooth
al-Islamiyyah magazine, vol. 9, p. 72) 

Thirdly, you say, “so the baby will find a father
and gets the name” This is the matter of attributing the child of adultery:
who is he to be named after? 

The answer is that the majority of scholars said
that the child of adultery should not be named after the adulterer,
because the Prophet (peace and
blessings of Allaah be upon him) said: “The child goes to the owner
of the bed and the adulterer gets nothing but the stones (despair, i.e.,
to be stoned to death).” (Agreed upon. Al-Bukhaari 2053; Muslim, 1457.
Al-Mughni by Ibn Qudaamah, vol. 7, p. 129) 

Fourthly, you say, that you would prefer the
woman to get rid of the baby. This is the issue of abortion, and the
ruling on that is as stated in the report of the Committee of Senior
Scholars (Hay’at Kibaar al-‘Ulamaa’), no. 140, dated 20/6/1407
AH, which is as follows: 

“1 – It is not permissible to abort the pregnancy
at any of its various stages except for a legitimate shar’i reason,
and within very narrow limits.

2 – If the pregnancy is in the first stage, which is
forty days, and aborting it will serve a legitimate shar’i interest
or ward off some harm, then it is permissible to abort it. But aborting
it at this stage for fear of difficulty in bringing up children or in
providing for them or teaching them, or fear for their future, or because
the couple feel that they have enough children – this is not permitted.

3 – It is not permissible to abort the pregnancy once
it has become an ‘alaqah (clot) or mudghah (chewed lump of flesh) [i.e.,
after 40 days’ gestation] unless a trustworthy medical committee has
stated that allowing the pregnancy to continue poses a danger to the
health of the mother, such that there is the fear that she will die
if the pregnancy continues. In this case it is permissible to abort
the pregnancy, after exhausting all other means of trying to ward off
that danger. 

After the third stage, and after the completion
of four months of pregnancy, it is not permissible for you to abort
the pregnancy unless a group of trustworthy specialist doctors decide
that leaving the foetus in his mother’s womb will lead to the death
of the mother; this is after exhausting all possible means of keeping
the foetus alive. Performing an abortion subject to these conditions
is permitted in order to ward off the greater of the two harms, and
to preserve the greater of the two interests.”

vol. 3, p. 1055) 

We ask Allaah to keep us safe and sound and to accept
our repentance. May Allaah bless our prophet Muhammad.

Who is the one who should carry out the hadd punishment for zina?

 

Is killing of a woman allowed for the sake of family honour ,if she is found guilty of anything that is not good for the family's name and honour ,for example she is blamed for adultery and is not proved yet or found to have relation with a na-mahrum(not related to her) ,If not kindly state some verses from Quran-e-Majeed and some Ahadiths which render such killings incorrect unless being processed through the court of Islamic Law? Did any such incident occur in the days of The Holy Prophet(P.B.U.H) and how was it dealt with?.

One of the gravest of major sins with which a person can meet
his Lord is the sin of killing a soul whose killing Allaah has forbidden. 

Allaah says (interpretation of the meaning): 

“And whoever kills a believer intentionally, his
recompense is Hell to abide therein; and the Wrath and the Curse of Allaah
are upon him, and a great punishment is prepared for him”

[al-Nisa’ 4:93] 

It was narrated that Anas (may Allaah be pleased with him)
said: The Prophet (peace and blessings of Allaah be upon him) was asked
about major sins, and he said: “Associating others with Allaah, disobeying
one’s parents, murder and bearing false witness.” Narrated by al-Bukhaari,
2510; Muslim, 88. 

It was narrated that Ibn ‘Umar (may Allaah be pleased with
him) said: The Messenger of Allaah (peace and blessings of Allaah be
upon him) said: “The believer will continue to have a good chance of
salvation so long as he does not shed haraam blood.” Narrated by
al-Bukhaari, 6469. 

It is not permissible to accuse chaste women of zina. Zina
can only be proven by the testimony of four men who see the act take place
with their own eyes, and see the penis enter the vagina, or by the unforced
confession of the man or woman who committed zina. 

Anything other than that is accusing a Muslim woman of zina,
for which the person should be given eighty lashes. 

Allaah says (interpretation of the meaning): 

“And those who accuse
chaste women, and produce not four witnesses, flog them with eighty stripes,
and reject their testimony forever. They indeed are the Faasiqoon (liars,
rebellious, disobedient to Allaah)”

[al-Noor 24:4] 

It was narrated that Abu Hurayrah and Zayd ibn Khaalid
al-Juhani (may Allaah be pleased with them both) said: The Messenger of
Allaah (peace and blessings of Allaah be upon him) said: “… Go
tomorrow, O Unays, to this woman and if she admits (to adultery) then stone
her.” He said: I went to her the next day and she admitted it, so the
Messenger of Allaah (peace and blessings of Allaah be upon him) ordered
that she be stoned.” Narrated by al-Bukhaari, 2575; Muslim, 1698. 

Allaah has specified the punishments for men and women who
commit zina. The hadd punishment is stoning if they have been married and
one hundred lashes for one who has not been previously married. 

Allaah says (interpretation of the meaning): 

“The fornicatress and the fornicator, flog each of them
with a hundred stripes. Let not pity withhold you in their case, in a
punishment prescribed by Allaah, if you believe in Allaah and the Last Day.
And let a party of the believers witness their punishment”

[al-Noor 24:2] 

It was narrated from Jaabir that a man from (the tribe of)
Aslam came to the Prophet (peace and blessings of Allaah be upon him)
when he was in the mosque and he said, “I have committed adultery.”  The
Prophet (peace and blessings of Allaah be upon him) turned his face
away from him. The man came to that side to which the Prophet had turned his
face, and testified against himself four times. The Prophet (peace and
blessings of Allaah be upon him) said, "Are you mad?” He said, “No.” The
Prophet said, “Are you married?" He said, "Yes.” So he commanded that he be
stoned in the Musalla (Eid prayer place). When the stones troubled him, he
ran away, until he was caught in al-Harrah and killed.  

Narrated by al-Bukhaari, 4969; Muslim, 1691. 

If it is asked: who is it that should carry out this hadd
punishment for zina? 

The answer is: 

No one should carry out the hadd punishments without the
permission of the ruler. If there is no ruler who rules according to
sharee’ah then it is not permissible for the ordinary people to carry out
the hadd punishments. Whoever does that is sinning, because carrying out the
hadd punishments requires examining the matter and requires shar’i knowledge
in order to know the conditions of proof. 

The ordinary people have no knowledge of such things, and the
carrying out of one of the hadd punishments by the ordinary people leads to
many evils and the loss of security, whereby people will attack one another
and kill one another or chop off one another’s hands on the grounds that
they are carrying out hadd punishments. 

Al-Qurtubi said: 

There is no dispute among the scholars that qisaas
(retaliatory punishments) such as execution cannot be carried out except by
those in authority who are obliged to carry out the qisaas and carry out
hadd punishments etc, because Allaah has addressed the command regarding
qisaas to all the Muslims, and it is not possible for all the Muslims to get
together to carry out the qisaas, which is why they appointed a leader who
may represent them in carrying out the qisaas and hadd punishments. 

Tafseer al-Qurtubi, 2/245, 246. 

Ibn Rushd al-Qurtubi said: 

With regard to the one who should carry out this punishment –
i.e., the hadd punishment for drinking alcohol – they agreed that the ruler
should carry it out, and that applies to all the hadd punishments. 

Bidaayat al-Mujtahid, 2/233. 

Al-Shawkaani said: 

It was narrated from Abu’l-Zinaad from his father that the
fuqaha’ of the people of Madeenah used to say that no one should carry out
any of the hadd punishments except the ruler, unless it is a man carrying
out the hadd punishment for zina on his male or female slave. Nayl
al-Awtaar, 7/295, 296. 

The family of the woman should prevent her from committing
immoral actions and should prevent the things that lead to that, such as
going out, speaking to non-mahram men, and everything that may enable her to
commit evil. If the only way is to detain her and tie her up, then they have
the right to do that, so they should detain her in the house. 

But as for killing her, they should not do that. Shaykh
al-Islam Ibn Taymiyah (may Allaah have mercy on him) was asked about a
married woman who had children and who formed an attachment to a man and
committed immoral actions with him. When she was found out, she tried to
leave her husband: did she have any right to her children after doing this?
Was there any sin on them if they cut off relations with her? Was it
permissible for the one who has proof of that to kill her secretly? If
someone else did that would he be sinning? 

He replied: 

Praise be to Allaah.  

Her sons’ and male relatives’ duty is to prevent her from
committing haraam actions, and if the only way they could do that is by
detaining her, then they should detain her. If it means that they have to
tie her up, then they should tie her up. But the son should not beat his
mother, and with regard to treating her kindly, they have no right to do
otherwise. It is not permissible for them to cut off ties with her so that
she is free to do evil actions, rather they should try to prevent her from
doing evil as much as possible. If she needs provision and clothing they
should provide that for her. And it is not permissible for them to carry out
the hadd punishment – execution or otherwise – on her, and they will be
sinning if they do that. 

Majmoo’ al-Fataawa, 34/177-178. 

It so happened that some women committed zina at the time of
the Prophet (peace and blessings of Allaah be upon him), and no one in
their families killed any of these women. One of them was al-Ghaamidiyyah
(may Allaah be pleased with her). 

It was narrated that Buraydah ibn al-Haseeb said: A woman
from Ghaamid, a branch of al-Azd, came and said: “O Messenger of Allaah,
purify me!” He said, “Woe to you! Go back and seek the forgiveness of Allaah
and repent to Him.” She said: “I think that you intend to send me back as
you sent Maa’iz ibn Maalik back.” He said, “What has happened to you?” She
said that she had become pregnant as a result of zina. He said: “Is it you
(who has done that)?”  She said: “Yes.” He said to her: “(You will not be
punished) until you give birth to that which is in your womb.” A man from
among the Ansaar sponsored her [i.e., paid for her needs etc] until she
delivered (the child). Then he (that Ansaari) came to the Prophet
(peace and blessings of Allaah be upon him) and said: “The Ghaamidi woman
has given birth to a child.” He (the Prophet (peace and blessings of
Allaah be upon him)) said: “Then we will not stone her and so leave her
child with no one to nurse him.” One of the Ansaar stood up and said: “O
Messenger of Allaah, let me be responsible for ensuring that he is nursed.”
Then she was stoned to death. 

Narrated by Muslim, 1695. 

So the attitude of the family of the woman asked about here,
claiming that she deserves to be executed, is wrong in other ways as well,
such as: 

1 – They do not have the attitude if one of their sons or
brothers commits zina. This is like the actions of the people of the
Jaahiliyyah who allowed themselves to commit zina but not their women. And
these people feel that their honour has been besmirched and their protective
jealousy comes to the for if their women commit sin, but there is no
protective jealousy on their part if one of their sons or brothers does the
same thing. Indeed some fathers boast about their son’s evil actions and
encourage him to do it.

2 – They have opened the door for women to fall into sin, by
allowing women to attend mixed schools, have bad friends, watch haraam
things and sit in reprehensible gatherings. This has led to women’s hearts
becoming deadened and attracted to immoral things. Some of them do not
arrange marriages for their daughters or sisters and they stipulate
impossible conditions, then they want to punish them when they are the ones
who deserve punishment more. 

3 – They don’t only kill for the sin of zina, rather they do
that even if the woman only spoke to or got to know a non-mahram man, for
which there is no hadd punishment of killing in sharee’ah. 

4 – They open the door for everyone who wants to kill his
sister or daughter on the grounds of nonsensical excuses, when the reason
for killing her may be her wealth, or because she knows things about them
that they want to conceal, or other such reasons. 

From time to time we hear claims from the kaafir west or the
deviant east that everyone who kills his sister or daughter does so because
of honour. That is because many laws let the killer off if he kills any
family member for this reason. 

Even though this claim may be true, we should not be deceived
by these people and their claims, because the purpose of these claims is to
remove gheerah (protective jealousy) from the hearts of the woman’s family,
and to open the door for women to commit immoral actions. 

What the guardians of women must do is to fear Allaah
regarding those who are under their care, and prevent them from committing
immoral actions or doing the things that lead to that, and not be either
careless or too strict. 

And Allaah knows best.

Can she marry someone who practices homosexuality?

 

I have a gay friend born in a muslim family. he has turned gay because of certain circumstances eg. absence of father and other things. i want to ask :


is he considered a muslim? can i marry him in the hope that it'll bring him to the right path once more?  i'm trying to change him back : is it okay for me to talk to him about sexual matters and all?  what if he promises me to try to be on the straight path if i marry him ? if i marry him, and some day he gives in to his temptation (ie has a sexual intercourse with a male), will that have any affect on our marriage ? if he has had sexual contacts with males, is it forgivable if he repents sincerely ?

Homosexuality is a major sin which deserves the most severe
of punishments in this world and in the Hereafter. See Question no.
5177. But the person who does that cannot be
described as a kaafir because of that, unless he thinks that it is
permissible and claims that it is halaal – in which he is to be denounced as
a kaafir. But simply doing it whilst admitting that it is haraam does not
put a Muslim beyond the pale of Islam. He is still a Muslim, but he is
exposed to the wrath of Allaah and is committing a major sin. It is not
permissible for you to go ahead and marry him until he repents sincerely.
Simply promising does not count as repentance. My advice to you is not to go
ahead and marry him, rather you have to look for a righteous man who will be
the means of bringing you happiness in this world and in the Hereafter.
Homosexuality, just like other major sins, is open to repentance: whoever
repents, Allaah will accept his repentance.

Now days we as Muslims have to spread the voice to learn quran and so we could gain the true knowledge and the quran teaching that is give to us by our beloved prophet Muhammad peace be upon him and do quran reading. Do we as Muslim ask our self that why we are at the peak of destruction? The answer will be simple that we have left our roots the holy quran we should guide promote Islam from in our homes first and let learn our kids quran  and encourage them in doing quran memorization this should be our first goal for it we can do different stuff like let then participate in different online quran recitation competition to let them listen quran from different online quran reciters and along with it we elders should learn quran also and improve our knowledge of quran and Islam and learn holy quran tafseer because to understand and learn quran Arabic and for this now a days there are many online quran tutor available who teach tajweed quran and its translation and tafseer so let us join our hands to be the voice of Islam and let improve the image of it as well and full fill our deputy .

Is hacking into banks’ websites and transferring money from them regarded as stealing that incurs the punishment of amputation?

 

Is hacking into bank websites via the internet and transferring money from them into the hacker’s account considered stealing? Should this hacker receive the punishment for stealing?.

Praise be to Allaah.

Stealing is haraam, and is a major sin. The Prophet
(peace and blessings of Allaah be upon him) said: “No thief is a believer at
the time when he is stealing.” Narrated by al-Bukhaari (5578) and Muslim
(57). 

Undoubtedly hacking into banks’ websites and transferring
money from them is haraam, and consuming people’s wealth unlawfully. 

As to whether it is something that incurs the punishment of
amputation, that is to be determined by the shar’i judge to whom the case is
referred. 

There are conditions which must be met before the thief’s
hand is amputated, such as that the property that is stolen should have been
taken from a proper storage place (in which wealth is usually kept). 

Imam al-Qurtubi (may Allaah have mercy on him) said:  

The majority of scholars are agreed that amputation can only
be carried out on one who took from a proper storage place that for which
amputation is deserved. 

A proper storage place is that which is usually set up to
store people’s wealth, which varies from one case to another. 

Ibn al-Mundhir said: There is no definite report or scholarly
opinion concerning that, rather it is like consensus among the scholars. End
quote. 

Tafseer al-Qurtubi (6/162). 

The scholars of the Standing Committee were asked:  

What are the conditions for amputating the hand in the case
of theft? 

They replied: 

For the hand of the thief to be cut off, nine conditions must
be met: 

1.    
Stealing, which is taking
wealth or property by stealth. If he seizes it forcibly or snatches it, then
there is no amputation.

2.    
The thief should be
accountable; there is no amputation for a child or one who is insane.

3.    
The stolen item should be above
a certain threshold; there is no amputation for anything less than that. The
threshold is one quarter of a dinar of gold, or the equivalent value of
other things.

4.    
The stolen item should be
something that is customarily kept and stored.

5.    
The stolen item should be
something concerning which there is no doubt.

6.    
It should be stolen from a
proper storage place.

7.    
It should be taken out of the
storage place.

8.    
Proof of the theft should be
established before the judge, with two witnesses of good character or a
confession from the thief.

9.    
The owner of the stolen item
should come forward and claim it. 

Examination of these conditions and the decision as to
whether they apply to a case of theft, is something that should be referred
to the shar’i courts. End quote.

A vehicle overturned in front of him and he hit it, and two people died

 

I was driving my car at a speed of 80 kph, which is less than the speed limit for that type of road, a two-lane coastal highway. Suddenly a bus came in the opposite direction, crossed the central reservation and overturned in front of me. I hit it straightaway because I could not avoid it, as it came out so suddenly. Two of the bus passengers died, and when I asked the passengers who were rescued from the accident they told me that the driver of the bus was not the original driver and he did not have a licence.


 My question is: do I have to offer expiation or pay the diyah (blood money) or not?.

If the matter is as you say, and you were travelling under the speed limit, and you were unable
to avoid hitting the bus, because it came out so suddenly and overturned in front of you, then there is no blame on you and you do not have to pay
the diyah or offer any expiation, because you did not break the rules and you were not negligent. 

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked about a person whose car
overturned, and his father who was travelling with him died – does he have to offer any expiation? 

He said: It is essential to determine the cause of the accident; if it was caused by negligence
or breaking the rules, then he has to pay the diyah and offer expiation. If it was not caused by breaking the rules or negligence on his part them
he does not have to do anything. 

Fataawa Islamiyyah, 3/357. 

The Standing Committee was asked a similar question and replied: 

If the driver was negligent or there is a reason that caused
the accident such as his breaking the rules or driving too fast, or he was drowsy and so on, or he was negligent in checking his car or neglected
some safety precaution, then he has to offer the expiation for killing, which is freeing a believing slave; if he cannot do that then he has to
fast for two consecutive months as an act of repentance to Allaah. If he did not cause the accident in any way, then he does not have to do
anything. 

Fataawa Islamiyyah, 2/356 

It says in a report of the Islamic Fiqh Council, issued during
its eighth conference in 1414 AH (1993 CE) concerning situations in which a driver is exonerated of blame: 

(a)  
If the accident happened as the result of reasons beyond his control, and he was unable to avoid it;
this includes anything that is beyond man’s control.

(b) 
If it was mostly caused by the one who was harmed.
